TERMS OF USE
These Terms of Use (hereinafter the “Terms”) govern access to and use of the Powor mobile application, published by Powor (hereinafter the “Publisher”), as well as the associated services accessible via the application (hereinafter the “Application” or the “Service”).

2. PURPOSE OF THE TERMS OF USE
These Terms are intended to define the conditions of access to and use of the services offered by Powor. They constitute a contract between the Publisher and any user of the Application. Access to the Application implies full and unconditional acceptance of these Terms.
Powor is a community-based mobile application dedicated to bodybuilding, allowing users to share their workouts, track their progress, interact with other members, access exclusive content, and benefit from social and premium features through the Club and Partner subscriptions. The Service also includes sports data tracking features, performance visualization, training consistency monitoring, and, where applicable, automated analysis and recommendation tools.
Powor is not intended for minors without effective supervision by a legal representative. Any minor must obtain prior consent from their legal representative before creating an account. The user undertakes to provide accurate information during registration.
Each user has a personal account. In the event of inactivity exceeding 24 months, Powor reserves the right to delete the account after prior notification. The user may request the deletion of their account at any time. Data will be deleted unless legal retention obligations apply.
Users may publish content on the Powor platform, including text, photographs, videos, sports data, comments, or any other material (hereinafter the “Content”). The user remains the sole holder of the intellectual property rights relating to their Content.
By publishing Content on Powor, the user grants Powor, for the duration of their registration to the service, a non-exclusive, free of charge, worldwide, and non-transferable license allowing Powor:
to host, store, and display the Content within the application and on the Powor website;
to reproduce and display the Content as part of the operation of the service;
to reuse the Content for communication, promotional, or service showcasing purposes, on any digital medium (application, website, social networks), in compliance with the user’s image rights and name.
This license terminates upon deletion of the user’s account, subject to legal data retention obligations or Content that has already been publicly communicated. The user warrants that they hold all necessary rights and authorizations to publish their Content and agrees not to publish any Content that infringes third-party rights, public order, or applicable laws and regulations.
Powor reserves the right to remove or moderate any Content that does not comply with these Terms or with applicable legislation.
Powor carries out content moderation in accordance with applicable law. Any user may report content or behavior that is unlawful or contrary to these Terms via the built-in reporting feature.

Powor reserves the right to suspend or delete any account or content that violates these Terms or applicable law, without prior notice, in the event of a serious breach.
Access to certain Powor features is subject to the subscription of a paid plan (including Powor Club or Powor Partner). Payments are processed through a secure third-party payment service provider, notably Stripe, allowing payment by credit card or any other payment method offered by that provider.
Powor does not have access to users’ banking details at any time.
Subscriptions are taken out for a fixed period (monthly or annual) and are automatically renewed, unless cancelled by the user under the conditions set out in the section relating to termination. Prices are indicated in euros, all taxes included, and may be subject to change. Any price change will be communicated to the user prior to its entry into force.
The user may cancel their subscription at any time directly from their personal account or the application settings. Cancellation takes effect at the end of the current subscription period, with no prorated refund, unless otherwise required by mandatory law.
Powor reserves the right to suspend or terminate a subscription in the event of fraud, abusive use, or violation of these Terms.

Users may invite friends via a Club code, giving access to discounts or benefits depending on the number of subscribers recruited. Certified partners (“Powor Partner”) receive a commission at a predefined percentage on subscriptions generated through their code, as part of the affiliate program. Any abuse, fraud, or behavior contrary to the Powor charter will result in the immediate removal of Partner status.

Powor collects and processes personal data in compliance with the General Data Protection Regulation (GDPR – EU 2016/679) and the French Data Protection Act. The collected data is used for account management, subscription management, and service improvement purposes.
Some data provided by the user may qualify as health data within the meaning of the GDPR. The processing of such data is based on the user’s explicit consent, given when accepting the Privacy Policy.
Users have the right to access, rectify, erase, restrict, object to, and port their data. These rights may be exercised at any time by writing to: contact@powor.app.

Powor uses all reasonable means to ensure the availability and security of the Service, without providing any absolute guarantee. The user acknowledges that they use the Application at their own risk. Powor cannot be held liable for any direct or indirect damage, including loss of data, business, or profits, resulting from the use of or inability to use the Service.
The Powor Application is intended for sports tracking and motivation purposes only. It does not replace medical advice. The user acknowledges that any physical activity involves risks and agrees to consult a healthcare professional before engaging in any training. Powor disclaims all liability in the event of injury or incident related to the use of the Application.
All content, visual identity, name, and the Powor logo are protected by copyright and trademark law. Any unauthorized reproduction or use is strictly prohibited.
Powor reserves the right to suspend or delete any account in the event of non-compliance with these Terms, fraud, abuse, or inappropriate content. The user may cancel their subscription at any time via their App Store or Google Play account settings.
Powor may amend these Terms in order to adapt them to legal or technical developments. Any modification will be notified via the Application. Continued use of the Service constitutes acceptance of the updated Terms.
These Terms are governed by French law. Any dispute relating to their interpretation or execution falls within the exclusive jurisdiction of the competent courts of Paris.
